使用我們的服務，即表示您同意本條款。因此請仔細閱讀條款內容。

服務的使用

您必須遵守服務中向您提供的所有政策。

1. 請勿濫用我們的服務。例如，您不應干擾服務的運作，亦不得試圖透過我們所提供的介面和指示以外的方法存取服務。您僅可於法律 (包括適用的出口及再出口管制法律和法規) 容許的範圍內使用我們的服務。如果您未有遵守我們的條款或政策，或者是如果我們正在調查疑似違規行為，我們可能會暫停或終止向您提供服務。
2. 有關您使用我們的服務，我們會向您發送服務公告、管理訊息和其他資訊。您可以選擇取消接收當中的某些通訊。

您的「易充站」帳戶

您需要擁有「易充站」帳戶才能使用我們的某些服務。您可自行建立「易充站」帳戶，或由管理者 (例如您的僱主) 為您指派 E-Charge帳戶。如果您使用的是管理者指派給您的「易充站」 帳戶，您的管理者可能可以存取或停用您的帳戶。
如果您發現密碼或帳戶被人盜用，請儘快通知我們。

私隱權及版權保障

「易充站」的個人資料(私隱)政策聲明會說明當您使用服務時，我們會如何處理您的個人資料並保障您的私隱權。使用我們的服務，即表示您同意EV Power可以根據我們的私隱權政策使用此等資料。
我們會根據《香港法例》所規定的程序，對涉嫌侵犯版權的通知作出回應，並終止一再侵權者的帳戶。

修改與終止服務

1. 我們會不停更新所提供的服務,包括新增或移除功能或特性及暫停或徹底停止某項服務。
2. 您隨時都可以停止使用服務，EV Power也可能隨時停止向您提供服務或對服務附加或設定新的限制。
3. 我們認為您的資料是屬於您的，因此有必要維護您對此等資料的存取。當我們中止某項服務時，在合理可行的情況下，我們都會給予您合理的事先通知，使您有機會能將資料從有關服務匯出。

我們的保證與免責聲明

我們會以商業上合理水平的技術與謹慎提供服務，希望您能樂於使用。但關於我們的服務的某些事項，我們卻不予保證。
除本條款或附加條款中所明示規定外，EV Power不會對服務作出任何特定保證。例如，我們不會就服務中的內容、服務之特定功能或其可靠性、可用性和符合您需要的能力作出任何承諾。我們僅以「現狀」提供服務。
某些司法管轄區會規定應提供特定保證，例如可商售性、某特定用途的適用性及未侵權之隱含保證。當法律容許時，我們會排除一切保證責任。

對服務的責任

1. 當法律容許時，EV Power對所損失的利潤、收入或資料、財務損失或間接、特殊、後果性、懲戒性或懲罰性損害賠償均不負責。
2. 在法律准許範圍內，EV Power於本條款所提出任何請求之總責任 (包括對任何隱含保證之責任)，均不超過您就使用服務而向EV Power 支付的金額 (或EV Power亦可選擇再次向您提供有關服務)。
3. 在所有情況下，EV Power對無法合理預見之任何損失或損害概不負責。

「易充站」服務的商業使用

如果您是代表某公司使用服務，即表示該公司接受本條款。該公司必須就任何因使用有關服務或違反本條款而引起或相關的申索、訴訟或法律行動 (包括所有因申索、損失、損害、訴訟、判決、訴訟費用和律師費用而產生的任何責任或費用)，向EV Power及其聯屬企業、主管人員、代理和員工作出彌償，並使其不受損害。

有關本條款的說明

1. 我們可能會修改本條款或適用於某項服務之任何附加條款，例如，以反映法律變更或服務變動而進行的修改。您應定期查閱本條款內容。這些條款如有修訂，我們將會在本網頁發佈通知。另外，我們亦會在相關服務中公布已修訂附加條款的通知。變更並無追溯權，而變更將於發佈修定通知起十四天或更長時間後方會生效。不過，就著某項服務新功能所作出的變更，或基於法律理由而進行的變更，將會立即生效。如果您不同意某項服務之修訂條款，請停止使用有關服務。
2. 如果本條款與附加條款有牴觸時，就該牴觸事項而言，應以附加條款為準。
3. 本條款規範EV Power 與您之間的關係。任何第三者受益權並不會因而產生。
4. 如果您不遵守本條款，而我們並未立即採取行動，這並不表示我們要放棄任何原本已有的權利 (例如未來再採取行動的權利)。
5. 如發生特定條款無法執行的情況時，任何其他條款並不會受到影響。

規管法律和司法管轄權

本使用條款受香港法律規管，而且應按照香港法律解釋。就因本使用條款引致或與本使用條款有關的任何申索或事宜而言，你特此接受香港法院的非專屬司法管轄權管轄。

充電站的使用條款

1. 「易充站」由香港電動能源有限公司提供予已獲香港特區政府或其授權部門發出有效牌照或車輛證明文件，並已登記成為「易充站」會員之電動車輛使用。
2. 使用電動車充電系統時，使用者須承諾依照電動車充電系統使用說明之指示使用。
3. 充電系統之使用者須確保其電動車輛在性能良好及安全情況下使用充電系統。
4. 若因使用者使用不當或在不合理使用情況下導致他人受傷或死亡或引致任何財物損毀破壞，本公司恕不負責有關人士因此所導致的索償､要求､訴訟､其他法律行動或責任，而有關人士須向充電器擁有者賠償。
5. 充電器具必須為電動車。

個人資料（私隱）政策聲明

電動能源有限公司（下稱「我們」或「我們的」）尊重　閣下的私隱權利，並且承諾遵守香港特別行政區法例第486章《個人資料（私隱）條例》之保障資料原則及要求。倘本政策之英文版本與其他語言的版本之間有任何不一致或相抵觸，將以英文版本為準。

資料收集、使用及分享

我們將收集　閣下的個人資料，用途可能包括:

1. 處理　閣下的投訴、查詢或回應；或
2. 用作識別和驗證　閣下的使用者身份。
3. 向　閣下提供貨品、服務及/或活動；
4. 向　閣下宣傳、推廣和介紹貨品、服務及/或活動；
5. 了解和分析有關使用本網站之人士的統計數據；及
6. 與上述相關的目的。

所有提供的私隱內容或個人資料是自願性的。然而，如　閣下未能向我們提供所要求的完整資料，則　閣下的要求將可能無法處理。就上述第(4) 項目的而言，我們會提供合適的退出選項。

資料保存

我們將保留　閣下的個人資料作上述用途，並銷毀無需保留的個人資料。

Welcome to E-Charge

Thanks for using our products and services (“Services”). The Services are provided by Hong Kong EV Power Limited (“EV Power”) located at Unit 606, Lakeside 1, No.8 Science Park West Avenue, Hong Kong Science Park,Shatin, New Territories, Hong Kong.
By using our Services, you are agreeing to these terms. Please read them carefully.

Using our Services

You must follow any policies made available to you within the Services.

1. Do not misuse our Services; for example, do not interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only as permitted by law, including applicable export and control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.
2. In connection with your use of the Services, we may send you service announcements, administrative messages and other information. You may opt out of some of those communications.

Your E-Charge Account

You need an E-Charge Account in order to use some of our Services. You may create your own E-Charge Account, or your E-Charge Account may be assigned to you by an administrator, such as your employer. If you are using an E-Charge Account assigned to you by an administrator, he/she may be able to access or disable your account.
If you learn of any unauthorised use of your password or account, contact us as soon as possible.

Privacy and Copyright Protection

EV Power’s Privacy Policies explain how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that EV Power can use such data in accordance with our Privacy Policies.
We respond to notices of alleged copyright infringement and terminate accounts of repeat infringers according to the process set out in the law of Hong Kong SAR.

Modifying and Terminating our Services

1. We are constantly changing and improving our Services, including add or remove functionalities or features and suspend or stop a Service altogether.
2. You can stop using our Services at any time while EV Power may also stop providing Services to you or add or create new limits to our Services at any time.

4. We believe that you own your data, and preserving your access to such data is important. If we discontinue a Service, where reasonably possible, we will give you reasonable advance notice and a chance to remove information from that Service.

Our Warranties and Disclaimers

We provide our Services using a commercially reasonable level of skill and care and we hope that you will enjoy using them; however, there are certain things that we do not promise about our Services.
Other than as expressly set out in these terms or additional terms, ev power makes any specific promises about the services. For example, we do not make any commitments about the content within the services, the specific function of the services or their reliability, availability or ability to meet your needs. We provide the services “as is”.
Some jurisdictions provide for certain warranties, like the implied warranty of merchantability, fitness for a particular purpose and non-infringement. To the extent permitted by law, we exclude all warranties.

Liability for our Services

1. When permitted by law, ev power will not be responsible for lost profits, revenues or data, financial losses or indirect, special, consequential, exemplary or punitive damages.
2. To the extent permitted by law, the total liability of ev power for any claim under these terms, including for any implied warranties, is limited to the amount that you paid us to use the services (or, if we choose, to supplying you with the services again).
3. In all cases, ev power will not be liable for any loss or damage that is not reasonably foreseeable.

Business uses of our Services

If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify EV Power and its affiliates, officers, agents and employees from any claim, action or proceedings arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, judgments, litigation costs and legal fees.

About these Terms

1. We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. You should read the terms regularly. We will post notice of modifications to these terms on this page. We will also post notice of modified additional terms in the applicable Service. Changes will not apply retrospectively and will become effective no earlier than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a Service, you should discontinue your use of that Service.
2. If there is any inconsistency between these terms and the additional terms, the additional terms will prevail to the extent of the inconsistency.
3. These terms govern the relationship between EV Power and you. They do not create any third party beneficiary rights.
4. If you do not comply with these terms and we do not take action immediately, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).
5. If it turns out that a particular term is not enforceable, this will not affect any other terms.

Governing Law, Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Hong Kong SAR. You agree to submit to the non-exclusive jurisdiction of the courts of Hong Kong SAR.

Terms & Conditions of E-Charge

1. The charging system is provided by Hong Kong EV Power Limited (“EV Power”) for electric vehicles (EV) of E – Charge members in Hong Kong which are properly licensed and certified by the Hong Kong government or the relevant agents.
2. Users undertake to comply fully with the E-Charge Instructions in the operation of the charging system.
3. Users are solely responsible for ensuring their EV are in good and safe condition and suitable for use with this charging system.
4. Users shall indemnify and hold harmless EV Power and the owner of chargers from and against any and all claims, demands, suits, actions or liabilities for damage to property or for injury or death of any person arising out of improper or unreasonable use of the charging system.
5. Only EV can be plugged into charger

Privacy Policy

Hong Kong EV Power Limited ("we", "our" or "us") respects your privacy and commits to comply with the data protection principles and the requirements of the Personal Data (Privacy) Ordinance (Chapter 486 of the Laws of Hong Kong Special Administrative Region). In case of any inconsistency or conflict between the English version and versions of other languages, the English version shall prevail.

Information Collection, Use, and Sharing

We shall occasionally collect personal data from you and such data will be processed for the specific purpose given at the time or for any purpose provided for in this policy. Such purposes may include

1. processing of your complaints, enquiries or feedback, or
2. identification and verification of you as a user.
3. provision of goods, services and/or activities to you;
4. promoting, marketing and advertising of any goods, services and/or activities to you;
5. understanding and analysing the statistics on the usage of the website by visitors; and
6. purposes relating thereto.

The provision of personal data or any information is voluntary. We might be unable to process your request if you do not provide us with complete information. Also, in relation to purpose (4) above, we shall provide suitable opt-out facilities.

Data Retention

We will keep your personal data for as long as necessary to fulfil the purpose for which the data was collected. Personal data which is no longer required will be destroyed.
